RE: Active Participation in the Arizona Business Enterprise Program

WHEREAS, the concept of Active Participation between the Licensed Committee of Blind Vendors and the State Licensing Agency is embedded in law; and

WHEREAS, Federal Regulations 395.14 (B) governing the Randolph-Sheppard Act require the Committee to actively participate with the State Licensing Agency in major administrative decisions and policy and program development decisions affecting the overall administration of the states’ vending facility program; and

WHEREAS, ongoing information sharing, discussion, good faith negotiation, consensus building, and joint decision making is a healthy process which can protect and expand business opportunities for blind entrepreneurs; and

WHEREAS, many years ago the National Federation of the Blind in collaboration with the Tennessee Business Enterprises Program developed a progressive definition of Active Participation; and

WHEREAS, this definition has received widespread adoption and application by many of the most successful Business Enterprise Program’s across the nation; NOW, THEREFORE

BE IT RESOLVED by the National Federation of the Blind in Convention assembled this twelfth day of September, 2010, in the city of Phoenix, Arizona, that this organization make every effort to assist the Rehabilitation Services Administration of Arizona and the Licensed Committee of Blind Vendors to adopt and make every effort to comply with the following definition of Active Participation in the governance and operation of the Business Enterprise Program:

ACTIVE PARTICIPATION- An ongoing process of negotiations between the State Licensing Agency and the Committee to achieve joint planning and approval of program policies, standards, and procedures affecting the overall operation of the vending facilities program, prior to their implementation by the Agency. The implementation of agreed upon policies, standards and procedures affecting the overall operation of the vending facilities program, shall be subject to review by the committee. It is understood that the agency bears final authority and responsibility for the administration and operation of the vending facilities program, including the assurance of continuing Active Participation with the committee.
